DynaKon Terms of Service
Effective October 12, 2026 · Last updated October 12, 2026
1. Who we are and what these Terms cover
DynaKon is a browser extension for Google Chrome ("DynaKon", "the Software") provided by Michael Connelly, an individual doing business as DynaKon, United States ("we", "us"). These Terms are an agreement between you and us about your use of the Software. Our Privacy Policy explains how information is handled.
By installing or using the Software you agree to these Terms. If you do not agree, uninstall the Software and do not use it.
2. Eligibility
You must be at least 13 years old, or older if your country sets a higher minimum age for using online services (for example 16 in some EU countries), to use the Software. If you are under the age of majority where you live, you may use the Software only with the permission of a parent or guardian. If you use the Software for an organization, you confirm you may accept these Terms on its behalf.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your own listening and music preparation, including professional DJ use, in each case subject to these Terms. You may not resell, sublicense, or provide the Software or its output as a service to others. The Software is licensed, not sold. All rights not expressly granted are reserved.
4. Restrictions
Except where the law expressly allows it despite this restriction, you may not:
- copy, modify, redistribute, sublicense, sell, rent, or host the Software;
- reverse engineer, decompile, or extract source code or algorithms from the Software;
- remove copyright or proprietary notices;
- use the Software to infringe the rights of others, or to record, copy, or redistribute content;
- use the Software to circumvent digital rights management or other technical protection measures on content you do not have the right to access; or
- interfere with the security or normal operation of the Software or of any website, or probe the Software for vulnerabilities in a way that harms other users. If you find a security problem, please tell us at the address in Section 19 so we can fix it.
5. Ownership
The Software, including its code, analysis methods, design, name, logo, and the DynaKon brand, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. © DynaKon 2026. All rights reserved. Names of websites, streaming services, and products mentioned in the Software or its listing belong to their owners; their use does not imply affiliation or endorsement.
6. Your audio and your information
DynaKon processes audio playing in your browser on your device, in real time. It does not record or store your audio and it does not send your audio or your listening history to us or to any third party. Settings and a small on-device memory of tuning are stored in your browser's local extension storage and removed when you uninstall the Software. This version of the Software sends no information over the internet. The Privacy Policy explains what the Software reads from web pages and how that information is used.
7. Permissions
For services that protect their audio (such as some streaming sites), the Software offers "Tune this tab". When you click it, the Software uses Chrome's tab-audio capture (the tabCapture, offscreen and activeTab permissions) to tune the sound of that one tab, only while you have it switched on, and stops when you leave the site or close the tab. The captured sound is processed on your device, is not recorded or sent anywhere, and the Software does not circumvent, copy, or remove any copy protection. You are responsible for using the Software only in ways that comply with the terms of the services you use. The Software requests access to web pages (http and https) so that it can tune audio and video you play on them. It reads media playback state, track title and artist information, and the website's hostname only to tune the sound and to show you audio details, and it may read a generic category of your audio output device when your browser makes the device name available, to choose suitable tuning. You can switch the Software off at any time, or for a particular site, from its panel.
8. Price and future paid features
This version of DynaKon is free. Every feature, including Track details, is available at no charge, and no payment, subscription, license key, or trial is offered or required.
We may introduce optional paid features or a paid plan in the future. If we do, we will announce it in the Software and on our website before it takes effect, we will not charge you for anything you have not knowingly chosen to buy, and we will update these Terms and the Privacy Policy first, including how payments, renewals, cancellation and refunds work. Features that are free in your installed version will not be removed from it without notice.
For questions, contact us at the address in Section 19.
9. Third-party content and services
DynaKon is not affiliated with any streaming service or website. You are responsible for complying with the terms of the services you use it with and for the content you play. Some sites protect their audio in ways that prevent processing; the Software may not work with them.
10. Listening safety
Audio processing can change the perceived loudness and tone of what you hear. Keep your volume at a safe level. You are responsible for protecting your hearing and your audio equipment.
11. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Audio analysis values such as loudness, key, tempo, and bandwidth are estimates and may be inaccurate. We do not guarantee uninterrupted or error-free operation, or compatibility with every website or browser version. Nothing in these Terms affects rights you have under mandatory consumer protection law that cannot be waived.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR EQUIPMENT, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for willful injury or violation of law (including as provided in California Civil Code section 1668), or for gross negligence where the law does not allow it to be limited. Some jurisdictions do not allow certain exclusions or limits, so parts of this Section may not apply to you.
13. Indemnity
To the extent permitted by law, you will defend and indemnify us against third-party claims, and resulting reasonable costs, that arise from your breach of Section 4 or from your unlawful use of the Software. This Section does not apply to you if you are a consumer in a place where the law does not allow it.
14. Termination
These Terms apply until terminated. You may stop at any time by uninstalling the Software. We may suspend or end your license if you materially breach these Terms, or stop offering the Software, in which case we will give reasonable notice where practical. Sections 4, 5, 11, 12, 13, 16, and 17 survive termination, as does any other provision that by its nature should.
15. Changes
We may update these Terms and the Software from time to time. We will post the updated Terms at www.dynakon.app/terms, change the "Last updated" date above, and, for material changes, note the change in the Software's update notes. Changes apply from the date they are posted, and to existing users 30 days after posting for material changes. If you do not accept a change, uninstall the Software. Continued use after that point means you accept the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Orange County, California, and you and we consent to the jurisdiction of those courts. This does not take away rights you have as a consumer under mandatory law where you live: if you are a consumer in the European Union, the United Kingdom, or another place that gives you the right to bring claims in your home courts or to the protection of your home country's mandatory consumer law, you keep those rights.
17. General
We may assign these Terms to an affiliate or a successor to the Software; you may not assign them without our written consent. If we do not enforce a provision, that is not a waiver of it. If any provision is found unenforceable, the rest remains in effect. You must comply with applicable export control and sanctions laws and may not use the Software where it is prohibited. We are not responsible for delays or failures caused by events beyond our reasonable control. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Software.
18. Notice to California users
Under California Civil Code section 1789.3, California users are entitled to the following specific consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
